Acceptance of Terms
By downloading, accessing, or using the NextUp application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
The App is operated by NEXTUP CLUB, LLC ("we," "our," or "us"), a Delaware limited liability company.
Description of Service
NextUp is a premium entertainment prediction platform that allows users to make picks for award shows, earn points for correct predictions, and compete on leaderboards. The App may also offer prizes to top performers at our sole discretion.
We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.
Eligibility
You must be at least 13 years of age to use NextUp. To be eligible to receive prizes, you must be at least 18 years of age (or the age of majority in your jurisdiction) and a legal resident of a jurisdiction where participation is permitted by law.
By using the App, you represent and warrant that you meet all eligibility requirements.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information when creating your account.
- Notify us immediately of any unauthorized use of your account.
- Not share your account with or transfer it to any other person.
- Not create multiple accounts to gain an unfair advantage.
We reserve the right to suspend or terminate accounts that violate these Terms.
Award Predictions & Points
NextUp allows you to submit predictions for award show categories before a designated lock time. Points are awarded for correct predictions according to the following tiered system:
- 50 points — Major categories (Best Picture, Directing, leading and supporting acting).
- 20 points — Craft categories (Screenplay, Cinematography, Editing, Score, and select feature categories).
- 10 points — Technical and short-form categories.
Points have no monetary value except where explicitly redeemed as part of a prize promotion. Point totals, tier status, and leaderboard rankings are determined solely by NextUp and our decisions are final.
We reserve the right to correct scoring errors, adjust point values, or modify the points system at any time.
Prizes & Promotions
NextUp may, at its sole discretion, offer prizes to users based on leaderboard performance or other criteria. The following terms apply to any prize promotion:
- No purchase necessary. A purchase does not improve your chances of winning.
- Eligibility. Prizes are open only to legal residents of jurisdictions where such promotions are permitted by law. Void where prohibited.
- Age requirement. Prize recipients must be 18 years of age or older (or the age of majority in their jurisdiction).
- Taxes. Prize recipients are solely responsible for all applicable federal, state, and local taxes. NextUp will issue appropriate tax documentation where required by law.
- Verification. Winners may be required to provide proof of identity and eligibility before receiving a prize.
- Substitution. We reserve the right to substitute a prize of equal or greater value if the advertised prize is unavailable.
- Official Rules. Each specific promotion may be governed by additional Official Rules, which will be made available at the time of the promotion.
NextUp employees and their immediate family members are not eligible for prizes.
Prohibited Conduct
You agree not to:
- Use any automated script, bot, or tool to submit predictions or interact with the App.
- Attempt to manipulate leaderboards, point totals, or prediction outcomes through fraudulent means.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Use the App for any unlawful purpose or in violation of any applicable law.
- Harass, abuse, or harm other users.
- Post or transmit any content that is defamatory, obscene, or otherwise objectionable.
Violations may result in immediate account termination and forfeiture of any accrued points or prizes.
Intellectual Property
All content, features, and functionality of NextUp — including but not limited to text, graphics, logos, and software — are owned by NextUp or its licensors and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.
Third-Party Services
NextUp integrates with third-party services including Google Sign-In, Apple Sign-In, and Firebase. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.
Disclaimers
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
NextUp does not guarantee the accuracy of any award show nominee or winner information displayed in the App.
Limitation of Liability
To the fullest extent permitted by applicable law, NextUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of points, prizes, or data.
Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100).
Indemnification
You agree to indemnify, defend, and hold harmless NextUp and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App or violation of these Terms.
Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in such courts.
Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by updating the effective date at the top of this page. Your continued use of NextUp after changes are posted constitutes your acceptance of the revised Terms.
